Everyday MVP Contest

OFFICIAL RULES

 

  1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. PARTICIPATION CONSTITUTES NOMINATOR’S AND NOMINEE’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES. The WTNH News 8 & Frontier Communications Everyday MVP Contest (the “Contest”) is sponsored by LIN Television Corporation, a Media General, Inc. company, d/b/a WTNH-TV (“WTNH”) and Frontier Communications Corporation (“Frontier”) (WTNH and Frontier are sometimes collectively referred to hereinafter as the “Contest Entities”). This Contest is offered only in Connecticut. Void outside Connecticut and where prohibited.

 

  1. Contest is subject to all federal, state and local laws. WTNH shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding nominations, deadlines, winner selection, prize restrictions, and eligibility — and all of its decisions are final. By participating in this Contest in any way, you agree to these Official Rules and to the decisions of WTNH.

 

  1. Contest Period. Contest begins on or about April 1, 2015 at 5:00 a.m. Eastern Time (“ET”). Final nomination deadline is September 30, 2015 at 9:00 a.m. ET. Winners will be selected and announced weekly from approximately April 6, 2015 until October 7, 2015. WTNH’s computer is the official time-keeping device for this Contest.

           

ELIGIBILITY

 

  1. All participants must be legal residents of Connecticut. Nominators must be at least eighteen (18) years old. Nominees must be enrolled in grades Kindergarten through twelfth (12th) grade.

     

  2. Employees of Contest Entities, any other entity directly involved in the development or administration of this Promotion, any other television stations in Connecticut, and the members of their immediate families (defined as spouses, parents, siblings and children) and households (whether or not related), are not eligible to participate or win. The term "household" includes all persons residing together in a single residence, whether or not related.

    Prizes

     

  4. Prizes (up to 23): Recognition in a story broadcast by WTNH during a News 8 broadcast (the “Feature Story”). Approximate Retail Value: $0.

    PRIZE RESTRICTIONS

     

  6. Feature Story prize has no cash or retail value and is offered at the sole discretion of WTNH. In the event that any Feature Story cannot be or is not fulfilled for any reason whatsoever, that winner will not be entitled to any compensation, substitution, remuneration or alternate prize of any kind. All prize details shall be at WTNH’s sole discretion. Each winner assumes sole responsibility for all expenses and incidental costs associated with participating in the Feature Story. Prizes are not redeemable for cash and may not be sold, bartered or auctioned. No substitutions will be permitted. The right to receive a prize is not transferrable.

  8. Any prize not accepted by any winner is forfeited and no cash substitute will be offered or permitted. Prizes offered are provided “as is” with no warranty or guarantee either express or implied by Contest Entities. Contest Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize. Other restrictions apply.

  10. Nominations will be accepted beginning April 1, 2015 at 5:00 a.m. ET and ending on September 30, 2015 at 9:00 a.m. ET. To submit a nomination, visit www.wtnh.com (the “Contest Page”) and follow the instructions to complete a nomination form with:

    1. All required contact information, which may include your name and contact information, the Nominee’s name, age, contact information (telephone number, mailing address, and/or e-mail address);

       

      1. A brief written paragraph written by you (the “Narrative”), describing the Nominee’s acts of achievement in the classroom, community, playing fields, etc. Your Narrative must satisfy all of the applicable “Submission Requirements” below.

       

       

    2. The nomination form and Narrative together constitute a “Nomination.” This is the only method of entering this Contest and Nominations will not be accepted via e-mail, regular or any other method. Each Nominator can submit up to one (1) Nomination. Additional Nominations received from any such Nominator thereafter will be subject to disqualification. The use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar methods or agents (including, but not limited to, contest-entry services or multiple or different e-mail addresses, identities, registrations, accounts or logins) is prohibited and may result in the disqualification of all Nominations submitted by that Nominator. No group submissions will be accepted.

    4. All Nominations must be received by WTNH no later than September 30, 2015 at 9:00 a.m. ET. Proof of sending is not proof of receipt by WTNH. WTNH will not accept screen shots as proof of nomination or entry.
    5.  

       

    6. Contest Entities are not responsible for, and Nominators assume all risk of, Nominations that are lost, misdirected, mutilated, garbled, distorted, truncated, incomplete, illegible, or containing errors or that for any reason are not received by WTNH prior to the stated deadline, and all such Nominations are void. Nominations that fail to include any of the information required above may be disqualified without further notification by WTNH. WTNH reserves the right in its sole discretion to disqualify any Nomination at any time that in its opinion does not comply with these Official Rules. Nominations become the property of WTNH and will not be returned or acknowledged.

    8. Each Nomination must include a valid e-mail address for the Nominator and preferably one for either the Nominee or his or her parent or legal guardian. WTNH is not responsible for electronic communications that cannot be delivered due to incorrect or out-of-date information provided by Nominator or Nominee or that are undeliverable as a result of any form of passive or active filtering of any kind. In the event of a dispute as to the identity or eligibility of a Nominator based on an e-mail address, the Nomination will be declared submitted by the Authorized Registered User of the e-mail address used at time of nomination. “Authorized Registered User” is defined as the person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

    10. The information that you provide about yourself in connection with the Contest may be used by (a) WTNH in accordance with WTNH’s Privacy Policy, which is found at wtnh.com/about-us/privacy-policy and which may be updated from time to time and/or (b) Frontier in accordance with Frontier’s Privacy Policy, which may be found at internet.frontier.com/privacy.html and which may be updated from time to time.

      Submission Requirements

       

    12. All Narratives must satisfy the following Submission Requirements:

      1. Narratives must be original to Nominator (not copied, adapted, or reproduced from any other source and not collaboration with any other person).
      2. No individuals other than Nominee and/or Nominator may be identifiable in any Narrative and Narrative may not contain any other personally identifiable information regarding any third parties.
      3. Narratives must not refer to or depict any identifiable trademark, trade name, logo, or brand names.
      4. Narratives must not describe or depict any content or statements that are inappropriate, lewd, pornographic, obscene, indecent, hateful, tortious, illegal, defamatory, slanderous, libelous, false, or disparaging, or that invade any person’s privacy or other rights, or that promote or advocate drug use, bigotry, racism, hatred, or harm against any group or individual, or that promote discrimination based on race, gender, religion, nationality, disability, sexual origin or age.
      5. Narratives must comply with all Terms of Use or other conditions that apply to the Contest Page.

       

       

  12. WTNH may reject any Narrative that it determines has violated the Official Rules (including the Submission Requirements), or is otherwise unsuitable, offensive, or in poor taste and disqualify the accompanying Nomination at any time during the Contest, even if the Nomination has already been submitted to the Contest Judges (as defined below) for consideration. You agree that WTNH has the sole discretion to decide whether any Narrative satisfies these Official Rules and that its decisions are final.

     

    Warranty/Indemnification by Nominator

     

  13. By submitting a Nomination and Narrative, you warrant that (a) the Narrative is original to and created solely by you and was not copied, in whole or in part, from any work belonging to anyone else, (b) the Narrative does not violate any copyright laws, and does not plagiarize, libel, slander, defame, disparage, or otherwise infringe on or violate the rights of any third parties, (c) you are legally entitled to submit the Narrative in the Contest; (d) the distribution, reproduction, display and any other uses of the Narrative by WTNH and/or Frontier, as the case may be, as permitted herein will not infringe any third party rights; and (f) the Nomination complies with these Official Rules. Each Nominator agrees to indemnify and hold harmless the Contest Entities, their parent companies and subsidiaries, and their respective officers, directors, employees and affiliated organizations, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the Nominator of these Official Rules or the warranties and/or representations made by Nominator pursuant to these Official Rules.

  15. In addition, by submitting a Narrative, you expressly grant to each of WTNH (and to those acting on WTNH’s behalf) and Frontier a non-exclusive, perpetual, irrevocable, world-wide, royalty-free license (and waive all moral rights in and to the Narrative) to display or otherwise use the Narrative on the Contest Page and any related sites in connection with this Contest.

  17. Beginning on or about April 6, 2015 and ending on or about October 7, 2015, timely and properly submitted Nominations will be reviewed by WTNH creative personnel (the “Contest Judges”), who will select approximately one (1) Nominee each week to highlight in a Feature Story, based on the Nominee’s positive attitude, “team player” character, actions in “doing the right thing,” efforts at self-improvement, and endeavors to excel, all as reflected in the Narrative (the “Judging Criteria”). Subject to verification of eligibility, the Nominees who are so selected will be declared the winners. WTNH reserves the right to select fewer than the stated number of winners if it does not receive a sufficient number of eligible Nominations.

  19. WTNH will contact either the potential winner (or his/her parent or guardian) in accordance with the information supplied to WTNH on the Nomination form. Each potential winner or parent/guardian must respond to initial notification within forty-eight (48) hours and may be required to present valid photo identification, signed affidavit or declaration of eligibility, liability release, publicity release (where legal), and/or other legal documents to WTNH no later than five (5) business days after initial notification. WTNH in its sole discretion may allow transmission of verification documents via fax or e-mail. WTNH will provide copies of such documents (including publicity release) to and/or for Frontier.

  21. In the event that any potential winner or parent/guardian (a) cannot be contacted directly by WTNH within forty-eight (48) hours from initial attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to participate in the Feature Story, (d) or is otherwise determined to be ineligible, that person will be disqualified and WTNH in its sole discretion may select an alternate winner from the remaining Nominations in accordance with the previously described criteria. Any alternate winners are subject to all eligibility requirements and restrictions of these Official Rules.

  23. Winners or their parents/guardians will be contacted to make arrangements to participate in the Feature Stories. WTNH may, in its sole discretion, post the names of the verified winners on the Contest Page and/or any of WTNH’s websites, including wtnh.com. Frontier may, in its sole discretion, post the names of the verified winners on the Frontier website, including www.frontier.com.

    PUBLICITY RELEASE

     

  25. By accepting a prize on behalf of the winner, each winner’s parent/legal guardian agrees to award each of WTNH and Frontier the right to publicize winner’s name, photograph (including the use and appearance of winner's photograph on WTNH’s and/or Frontier’s web page), likeness, biographical information, e-mail address, voice and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

    LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY

     

  27. By entering the Contest or accepting a prize, you (or your parent/legal guardian if you are a minor) hereby agree that each of the Contest Entities, Media General, Inc., Facebook, and a range of subsidiaries, directors, agents, agencies, affiliates, distributors, retailers, franchisees, promoters, officers, directors, employees, and all of their respective advertising and promotional agencies, representatives, contractors and related persons (collectively, “Released Parties”):

    1. are not responsible for technical failures of any kind, including but not limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for Nominations that for any reason are not received by WTNH by the deadlines stated above;

     

     

    1. are not responsible for any incorrect or inaccurate information, whether caused by Nominators, Nominees or other persons, or by printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest or in the printing of this offer, administration of this Contest, or in the announcement of the winners;

     

     

    1. are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in any part of this Contest or of downloading of any software or materials;

     

     

    1. are not responsible for unauthorized human intervention in any part of the Contest, including without limitation, the Nomination and Judging processes;

     

     

    1. are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Contest, the uploading and/or processing of Nominations, the announcement of the winners, the prizes or otherwise in any Contest-related materials;

     

     

    1. are not responsible for any unauthorized third party use of any Nomination (including any Narrative);

     

     

    1. are not responsible for the inability to select the winners because of postal failure, equipment failure, or data storage failure; and

     

     

    1. are released from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, arising in whole or in part directly or indirectly, from participating in the Contest (in whole or in part), the use (including modification, adaptation, and reproduction) of Nomination materials (including Narratives) during or after the Contest, and the delivery, acceptance, possession, use, misuse, loss, or misdirection of any prize.

     

     

  29. RELEASED PARTIES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE Prizes. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR (OR YOUR CHILD’S IF APPLICABLE) USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE CONTEST OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF Prizes OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE CONTEST OR RELATED WEBSITES WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE CONTEST. RELEASED PARTIES WILL NOT BE LIABLE, AND ARE NOT RESPONSIBLE, FOR DAMAGES OF ANY KIND RELATED TO YOUR PARTICIPATION IN OR INABILITY TO PARTICIPATE IN THE CONTEST, WHETHER THE DAMAGES ARE DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL.

  31. BY ENTERING THE CONTEST AND/OR ACCEPTING A PRIZE, YOU (OR YOUR PARENT/GUARDIAN IF YOU ARE A MINOR) AGREE THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR, AND WILL BE HELD HARMLESS BY YOU AGAINST, ANY LIABILITY FOR ANY DAMAGE, INJURY OR LOSS TO PERSON (INCLUDING DEATH) OR PROPERTY RELATED IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO ACCEPTANCE, POSSESSION, USE OR MISUSE OF any prize, PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY, USE BY A RELEASED PARTY OF ANY NOMINATION (INCLUDING ANY NARRATIVE), PARTICIPATION IN THE CONTEST IN ANY WAY, OR ANY OTHER CLAIM OR CAUSE OF ACTION YOU MAY HAVE AGAINST A RELEASED PARTY.

  33. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.
  34.  

     

    MISCELLANEOUS

     

  35. WTNH reserves the right to cancel, terminate or suspend this Contest or any part of this Contest in the event that WTNH determines, in its sole discretion, that the security, administration, fairness and/or operation of the Contest has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond WTNH’s control. In such event, WTNH reserves the right to post notice of same at the Contest Page and determine the winners from among all non-suspect eligible Nominations received at the time of the Contest termination in accordance with the previously described selection process or through such other method as WTNH, in its sole discretion, deems fair and appropriate under the circumstances.

  37. WTNH reserves the right to prohibit any person from further participation in any part of the Contest if WTNH concludes, in its sole discretion, that such person has (a) attempted to tamper with the Nomination or Judging processes, or the operation of the Contest in any other way, (b) has attempted to unfairly affect the outcome of the Contest, (c) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (d) has acted towards any Contest Entity or any other Nominator or Nominee in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes the use of any prohibited device or method to submit Nominations. Any failure by WTNH to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.

  39. ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND WTNH RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT

  41. All activity arising out of and relating to the Contest, including any reference to a Nominee's status as a "winner" is subject to verification and/or auditing for compliance with the Official Rules and potential winner and his/her parent/legal guardian agree to cooperate with WTNH concerning such verification and/or auditing. If WTNH determines, in its sole discretion, that verification or auditing activity evidences non-compliance of a Nomination, Nominator and/or Nominee with the Official Rules, WTNH reserves the right to disqualify the Nominee and/or remove the Nomination from the Contest at any time. WTNH reserves the right to conduct a background check on any or all potential winners and to disqualify any individual based on such background check if WTNH determines in its sole discretion that declaring any such individual to be a winner might reflect negatively on WTNH. Each Nominee (and his/her parent or guardian, if a minor) agrees to cooperate with WTNH and its representatives in connection with any and all verification, auditing and/or background check activities.

  43. WTNH reserves the right to correct typographical, printing or clerical errors in any Contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, WTNH reserves the right to award only the stated number of prizes by selecting the winners from all legitimate, un-awarded, eligible prize claims in accordance with the previously announced selection process.

    TRADEMARKS

     

  45. Facebook is not a sponsor of this Contest. Any third party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third party trademarks in these Official Rules or in the Contest is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Contest.
  46.  

     

    DISPUTES

     

  47. By participating in the Contest or accepting a prize, you (and your parent or legal guardian if you are a minor) agree that:

    1. all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any person or Contest Entity in connection with the Contest, shall be governed by Connecticut law without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Connecticut;

       

    2. any legal proceedings arising out of this Contest or relating to these Official Rules shall be instituted only in the federal or state courts located in New Haven County, Connecticut, and you (and your parent or legal guardian if you are a minor) consent to the mandatory and exclusive jurisdiction therein with respect to any such legal proceedings or disputes;

       

      1. any and all disputes, claims, and causes of action arising out of or connected in any way with the Contest or any prize shall be resolved individually, without resort to any form of class action;

       

       

      1. any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and

       

       

      1. you (and your parent or legal guardian if you are a minor) will not under any circumstances be permitted to obtain any award for, and you voluntarily and freely waive all rights to claim any award for, punitive, incidental or consequential damages or any and all rights to have damages multiplied or otherwise increased, or any damages other than actual out-of-pocket expenses.

       

       

      Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you.

       

    3. In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Contest-related materials, including but not limited to the Contest nomination forms, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control.

  49. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
